About these T&Cs
These terms and conditions ensure that all parties involved understand their responsibilities and legal implications of the agreement, providing a clear framework for the pre-owned online store.
These Terms and Conditions govern the assessment, sale, purchase and listing of pre-owned solar equipment through Solar Europe’s Client Zone. By engaging with Solar Europe on this platform, you acknowledge and agree to the terms outlined below.
Submission of Equipment
Clients may submit their pre-owned solar equipment to Solar Europe for evaluation. Solar Europe reserves the right to refuse assessment of equipment that is visibly damaged beyond repair, incomplete, or not compliant with applicable safety and industry standards.
Assessment Standards
Solar Europe will assess all submitted equipment using Original Equipment Manufacturer (OEM) approved procedures and standards to determine:

The functionality of the equipment.

The physical condition, including signs of wear, damage, or tampering.

Compatibility with current market standards and operational efficiency.
Inspection & Testing
Equipment will undergo a thorough inspection and testing process conducted by Solar Europe’s certified technicians at an OEM-approved repair and testing centre. Testing will include electrical performance checks, visual inspections, and any additional diagnostics required to verify the condition of the equipment.
Detailed Product Report
Following the assessment, a detailed product report will be compiled, which will include:

The product’s condition and functionality.

Any defects or signs of previous repair work.
-
Key specifications and performance metrics.
-
An assessment of whether the equipment qualifies for any remaining manufacturer’s warranty.
The product report will be included in the listing on Solar Europe’s pre-owned store to ensure transparency and provide potential buyers with all relevant information
Outcome of Assessment
Solar Europe will either make an offer to purchase the equipment outright or assist the client in listing the product on the pre-owned store.
If no offer is made or accepted, the equipment will remain the client’s property, and they may choose to collect it or proceed with a listing under the agreed terms.
Assessment Fee
Solar Europe reserves the right to charge an assessment fee for the testing and inspection process, which will be communicated upfront. This fee may be waived if Solar Europe purchases the equipment directly or if the item is successfully sold through the pre-owned store.
Client Responsibility
Clients are responsible for ensuring that the equipment submitted for assessment is complete, functional, and safe for testing. Solar Europe is not liable for damage arising from inherent defects or pre-existing conditions in the equipment during the assessment process.

Options Available
a) Make an Offer
Solar Europe may offer to purchase the equipment outright at a value determined based on:

The current market demand and pricing for similar equipment.

The condition and functionality of the equipment were determined during the assessment.

Any remaining manufacturer’s warranty or value-adding features.
Upon acceptance of the offer, the client will receive the agreed payment, and ownership of the equipment will transfer to Solar Europe. Payment will be processed via Electronic Funds Transfer (EFT) and will be subject to the clearance of funds before finalizing the transaction.
b) List on Behalf of the Client
If Solar Europe does not make an outright offer or the client does not accept the offer, Solar Europe may assist in listing the equipment on its pre-owned online store.
Solar Europe will:

Collaborate with the client to determine a realistic asking price based on market conditions and the product’s assessed value.

Add markup to the client’s agreed price to account for administrative, operational, and listing costs.
-
List the equipment on the online store with a detailed product report, including all relevant specifications and conditions of sale.
Client's Decision
The client will have the opportunity to review Solar Europe’s assessment report, offer, and proposed listing terms.
a) If an offer is accepted:
Solar Europe will process payment for the agreed-upon value and ownership of the equipment will transfer to Solar Europe immediately upon payment.
b) If an offer is declined or no offer is made:
The client retains ownership of the equipment until it is sold through the online store. The client may choose to adjust the asking price or withdraw the listing at any time before the equipment is sold.
Ownership Transfer of Listed Equipment
Ownership of the equipment will only transfer to the buyer upon finalisation of the sale. Solar Europe acts solely as an intermediary, facilitating the transaction between the client and the buyer.
Payment to Client for Listed Equipment
Once the listed equipment is sold, Solar Europe will process payment to the client for the agreed portion of the sale price after deducting any applicable fees or charges. Payments will only be made via EFT after the buyer’s payment has cleared in Solar Europe’s account.
Unlisted Equipment
Equipment not accepted for listing or purchase by Solar Europe will remain the client’s responsibility. The client must collect unlisted equipment within 10 working days unless other arrangements have been made.

Transparent Product Listings
The equipment will be listed on Solar Europe’s pre-owned online store with full transparency, including:

A detailed description of the equipment, its specifications, and its current condition.

The findings of the inspection report, ensuring buyers have complete knowledge of the product.

Clear pricing, terms of sale, and applicable warranty (if any).
Price Setting & Adjustments
The client has the opportunity to set their desired price for the equipment. Solar Europe will provide professional guidance to adjust the price to align with current market trends, ensuring a realistic and competitive listing. A markup will be added to the client's agreed price to cover operational costs, including inspection, testing, listing management, and transaction facilitation.
Sales Process
Solar Europe will actively manage the sales process including:

Promoting the listing on its online store and marketing channels.

Facilitating communication with potential buyers.
-
Negotiating terms of sale, if necessary, per the client’s price expectations.
Solar Europe acts as an intermediary and does not take ownership of the equipment unless it is purchased outright during the assessment.
Payment to the Client
Once the equipment is sold, payment will be made to the client via EFT (Electronic Funds Transfer) only. Payment will be processed only after:

The buyer’s payment has cleared in Solar Europe’s Account.

All terms of the sale have been finalized.
Solar Europe will notify the client of the sale and provide a breakdown of the final transaction, including any fees or deductions.
Collection of Equipment by the Buyer
Solar Europe will facilitate the buyer’s collection of the purchased equipment. Solar Europe will not deliver pre-owned equipment. Buyers must arrange their own collection. Ownership of the equipment will only be transferred to the buyer once full payment has been received and cleared.
Unsuccessful Listings
If the equipment does not sell within a mutually agreed-upon time frame, Solar Europe may recommend price adjustments or other strategies to increase marketability. The client may choose to withdraw their equipment from the listing at any time before the sale is finalized.

No Warranties by Solar Europe
Solar Europe does not provide any warranties, express or implied, on pre-owned equipment or materials sold through its pre-owned online store. All pre-owned equipment is sold on an “as-is” basis unless specified otherwise in the product listing.
Standard Manufacturer's Warranty
Pre-owned equipment may still qualify for any remaining standard manufacturer’s warranty, as stipulated in the product’s brochure, datasheet, or warranty card. Manufacturer’s warranties are governed by the manufacturer’s terms, conditions, and discretion. Details regarding the validity and terms of any remaining warranty will be provided in the product’s listing and can be verified through the manufacturer’s official channels.
Warranty Voidance
Equipment sold through Solar Europe’s pre-owned online store will lose any active warranties if:

Repairs are required after the assessment phase and are performed outside the manufacturers' approved processes or repair centres.
-
The equipment has been altered, tampered with, or subjected to misuse or improper installation.
Warranty Maintenance
If no repairs are required during or after the assessment phase, the equipment may retain any remaining manufacturer’s warranty, provided it adheres to the terms stipulated by the manufacturer. Solar Europe will specify in the product listing if the manufacturer’s warranty is still valid and provide instructions for warranty claims if applicable.
Extended Warranties
Extended Warranties on solar equipment are dependent on site-specific factors such as installation quality and compliance with applicable laws and standards, and other equipment paired with when originally installed, thus no extended warranties will apply to any products sold through Solar Europe’s pre-owned online store. Any previously active extended warranties are void upon the listing of the equipment on Solar Europe’s pre-owned online store.
Client Responsibility for Warranty Claims
Clients or buyers are responsible for handling warranty claims directly with the manufacturer or its authorized service centres. This includes:

Removing and shipping the defective product to the designated repair or warranty centre.

Covering any associated costs if the manufacturer determines the defect is not covered under warranty.

Following up with the manufacturer or repair centre for updates on resolutions.
Warranty Limitations
Solar Europe does not guarantee the outcome of warranty claims submitted to manufacturers. Manufacturer warranty assessments, repairs, or replacements are subject to the manufacturer’s timelines, policies, and decisions.

Responsibility for Repairs
It is the sole responsibility of the client, installer, or end-user to:

Remove the affected product from its installation site.
-
Arrange for the product to be returned to the appropriate repair or warranty centre.
-
Cover any associated costs for removal, transportation, and reinstallation unless explicitly covered by the manufacturer’s warranty.
Assessment Process at Solar Europe's Repair Centre
Solar Europe operates an OEM-approved and certified repair centre staffed by qualified and experienced technicians. The repair centre adheres to strict OEM procedures and uses genuine parts to ensure the highest quality of service. The general lead time for assessment at Solar Europe’s repair centre is 8 to 10 working days, depending on the complexity of the product and workload.
Notification of Assessment Results
Once the assessment is complete, Solar Europe will provide the client with a detailed report outlining the findings, including:

The cause of the product failure.

Whether the issue is covered under the manufacturer’s warranty.
-
A cost estimate for repairs if the failure is not covered under warranty.
Manufacturer Repairs
If the product must be sent to the manufacturer’s repair centre, Solar Europe will coordinate the process and provide regular updates. Solar Europe has no control over the timelines of manufacturer repairs and can only relay updates provided by the manufacturer. Any decisions regarding warranty coverage or repair costs are at the sole discretion of the manufacturer.
Repair Charges
If the failure is determined to result from misuse, negligence, tampering, or other conditions not related to product quality, the client, installer, or end-user will be responsible for:

All repair costs as quoted by the repair centre or manufacturer

Any additional costs for shipping and handling.
Payment for non-warranty repairs must be made in full before the repaired product is returned to the client.
Warranty & Repairs
Repairs conducted by Solar Europe’s OEM-approved repair centre will not extend or renew any remaining manufacturer warranty unless explicitly stated by the manufacturer. Any unauthorized repairs or use of non-genuine parts will void the manufacturer’s warranty.
Regular Updates
Throughout the repair process, Solar Europe will provide clients with updates regarding the status of their product and notify the client immediately upon completion of the repair or when the manufacturer provides a final decision.
Liability for Delays
Solar Europe is not liable for delays caused by factors beyond its control, including but not limited to:

Backlogs at the repair or warranty centre.

Availability of replacement parts.
-
Manufacturer response times or operational delays.

Scope of Indemnity
Solar Europe assumes no liability and is not responsible for any claims, losses, damages, or expenses arising from or related to the following:

Failure or malfunction of Equipment: Any failure, malfunction, or defect in pre-owned equipment sold through the online store, whether such issues arise immediately or after a period of use.

Misrepresentation or False Declarations: Misrepresentation or false declarations made by clients regarding the condition, origin, or warranty status of their equipment during the assessment or listing process.

Repair Delays or Issues: Delays, errors, or unsatisfactory outcomes in repairs handled by third-party repair centres or manufacturers, including warranty disputes or extended repair timelines.

Improper Use or Installation: Damage or loss resulting from improper installation, misuse, or negligence by the buyer, installer, or end-user.
-
External Factors Beyond Solar Europe’s Control: Losses caused by external factors, such as natural disasters, power surges, or any events outside Solar Europe’s reasonable control.
Client & Buyer Responsibilities
By participating in the sale or purchase of equipment through Solar Europe’s pre-owned online store, clients and buyers acknowledge and accept the following responsibilities:

It is the buyer’s duty to thoroughly review the product details and inspection reports provided in the listing before making a purchase.

The client guarantees the accuracy and honesty of all information supplied to Solar Europe during the assessment and listing process.

The buyer is responsible for ensuring proper installation, operation, and maintenance of purchased equipment in accordance with manufacturer guidelines.
Agreement to Indemnity
By purchasing or selling equipment through Solar Europe’s pre-owned online store, clients and buyers agree to indemnify and hold Solar Europe harmless from and against any claims, liabilities, or damages, including but not limited to:

Legal fees, costs, and expenses arising from disputes related to the sale, use, or repair of pre-owned equipment.

Compensation claims from third parties for damages or losses caused by the equipment after the point of sale.
-
Claims arising from breaches of manufacturer warranties or failures unrelated to Solar Europe’s assessment or listing process.
Disclaimer of Liability
Solar Europe does not guarantee or warrant:

The performance, reliability, or longevity of pre-owned equipment sold through its online store.
-
The outcome of warranty or repair claims submitted to manufacturers or repair centres.
-
The suitability of any pre-owned equipment for a specific purpose or installation environment.
Binding Nature of Indemnity
The indemnity agreement is binding upon all parties who choose to engage with Solar Europe’s pre-owned online store. By proceeding with a sale, purchase, or repair request, all parties explicitly waive any right to hold Solar Europe liable for damages or losses falling within the scope of this indemnity.

Applicable Laws
These Terms and Conditions, and all transactions, interactions, or disputes related to Solar Europe’s pre-owned online store, shall be governed by and construed in accordance with the laws of the Republic of South Africa. This includes, but is not limited to, relevant statutes, regulations, and common law principles applicable to commercial transactions and consumer protection.
Jurisdiction
Any disputes, claims or legal proceedings arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa. Disputes may be brought before competent courts within the territory where Solar Europe’s primary office or operations are located unless otherwise agreed upon in writing by all parties.
Dispute Resolution
Before escalating any disputes to court, parties are encouraged to resolve issues amicably through negotiation or mediation. Solar Europe reserves the right to propose alternative dispute resolution methods, such as arbitration, to expedite the resolution process and reduce costs.
Legal Interpretation
Any ambiguities or uncertainties in these Terms and Conditions will be interpreted and enforced in accordance with South African legal standards and principles. If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable under South African law, the remaining provisions shall remain in full force and effect.
Client Acknowledgement
By engaging with Solar Europe’s pre-owned online store, clients and buyers acknowledge their understanding and acceptance of the governing law clause and agree that any legal disputes will be resolved within the framework of South African law and jurisdiction.
International Considerations
For clients or buyers operating outside South Africa, it is their responsibility to ensure compliance with their local laws and regulations regarding the purchase, sale, or use of pre-owned equipment. Solar Europe will not be held responsible for any legal implications arising from international transactions.
Solar Europe reserves the right to amend these Terms and Conditions at any time. Changes will be communicated on the Solar Europe website and will take effect immediately upon publication.
