About these T&Cs

 

These Terms and Conditions (“Agreement”) govern the operations and services of the Solar Europe (Pty) Ltd Repair Centre (“Repair Centre”). By utilizing the Repair Centre’s services, clients and installers (“Customer”) agree to these terms. Solar Europe reserves the right to amend this Agreement at its sole discretion and without prior notice. Any changes will be effective immediately upon publication.

  • Solar Europe (Pty) Ltd (“Solar Europe”) does not carry any warranties on products supplied other than those manufactured by Solar Europe. Standard manufacturer’s warranties, as outlined in the product’s brochure, datasheet, or warranty card, apply to all products and equipment supplied by Solar Europe. Manufacturer warranty details can be accessed on the respective manufacturer’s website. Product warranties are subject to the discretion and terms set forth by the manufacturer. Solar Europe is not responsible for decisions regarding warranty claims made by manufacturers. Products supplied by Solar Europe but manufactured by third parties are warranted only for the duration and under the terms specified by the manufacturer.

  • Fault Reporting

    Should a product fail, the Customer must report the issue to Solar Europe’s Repair Centre and return the faulty product for assessment.

    Assessment Lead Time

    The general lead time for product assessments is 8 to 10 working days. This timeline is dependent on the manufacturer’s or repair centre’s assessment schedule. Solar Europe cannot guarantee expedited assessments.

    Assessment Outcomes

    Upon receiving the assessment report, Solar Europe will notify the Customer of the outcome, indicating whether repairs will be covered under warranty or payable by the Customer.

    Repair Authorization

    Repairs will only commence after obtaining explicit approval from the Customer. If a repair is deemed outside warranty coverage, the Customer will be issued a quote for repair costs.

    Outcome of Assessment

    Solar Europe will either make an offer to purchase the equipment outright or assist the client in listing the product on the pre-owned store.

    If no offer is made or accepted, the equipment will remain the client’s property, and they may choose to collect it or proceed with a listing under the agreed terms.

    Undetermined Repair Costs

    It is noted that the repair centre may not be able to estimate total repair costs in advance. Parts will be repaired or replaced incrementally to restore product functionality, and the total cost will be outlined in the final invoice.

    Rejected Quotes

    If the Customer does not approve the repair quote, a handling fee will be charged. The Customer must pay this handling fee before the product can be released.

    No Control Over Timelines

    Solar Europe has no control over repair durations and will provide updates as received from the manufacturer or repair centre.

  • Solar Europe is not liable for delays, losses, or damages to property or income caused by repair timelines or unavailability of products. Solar Europe is not responsible for any additional costs incurred due to misuse, negligence, tampering, or any condition unrelated to product quality and/or functionality. The Customer is liable for all costs associated with repairs, replacements, or related charges resulting from the aforementioned conditions.

  • Collection Timeline

    Products booked for repair must be collected within three (3) months from the date the Customer has been notified of the completed repair job.

    Forfeiture of Ownership

    If the product is not collected within the stipulated three-month period, the Customer agrees to forfeit ownership of the product. The Repair Centre reserves the right to retain or dispose of the product to recover repair and/or storage costs.

    No Liability for Unclaimed Products

    Solar Europe is not liable for any loss or damages arising from the forfeiture or disposal of unclaimed products.

  • Installers are responsible for removing faulty products from installations and delivering them to the Repair Centre or manufacturer’s warranty centre for assessment. Installers must ensure adherence to all applicable safety and quality standards during product removal and reinstallation. Installers are liable for all costs incurred if product failure results from misuse, negligence, tampering, or improper installation.

  • Failures caused by the following conditions are not covered under any warranty:

    • Misuse or abuse by the Customer.

    • Negligence or tampering.

    • Self-inflicted damage.

    • Malicious damage.

    • Fire, natural disasters, or Acts of God.

    In such cases, the Customer will be charged for all associated repair and replacement costs, including labour charges.

  • Repair quotes must be approved, and payments must be made in full before repaired products are released to the Customer. Handling fees for rejected quotes must be paid before unapproved products can be returned to the Customer. All payments must be made to Solar Europe via Electronic Funds Transfer (EFT). The Customer is responsible to confirm Solar Europe's banking details before making payment. A banking confirmation letter will be provided upon request.

  • The Customer agrees to indemnify and hold harmless Solar Europe, its officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or related to:

    • The use or handling of the product.

    • Failure to comply with these Terms and Conditions.

    • Misuse or improper installation of products by installers or end-users.

  • This Agreement shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with this Agreement shall be resolved through good-faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to arbitration in accordance with the rules of the Arbitration Body. The arbitration decision shall be final and binding on both parties.

  • Entire Agreement

    This Agreement constitutes the entire agreement between Solar Europe and the Customer regarding the Repair Centre’s services.

    Amendments

    Solar Europe reserves the right to amend this Agreement at its sole discretion and without prior notice. Any changes will be effective immediately upon publication.

    Severability

    If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    Notices

    All notices required or permitted under this Agreement shall be published on Solar Europe's Client Zone (this site) for ease of access by all parties.

  • Entire Agreement

    This Agreement constitutes the entire agreement between Solar Europe and the Customer regarding the Repair Centre’s services.

    Amendments

    Severability

    If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
