South Africa

If you are using this Website in Southern Africa, you irrevocably agree that the law of the Republic of South Africa shall govern your use of this Website and these Terms.

You further consent to the jurisdiction of the South Gauteng High Court, Johannesburg, South Africa, for any disputes arising out of your use of the Website and these Terms.

Additionally, you irrevocably and unconditionally consent to the jurisdiction of the Magistrates' Court, even if the value of a claim we may have against you exceeds the ordinary monetary jurisdiction of the Magistrates' Court.

You may terminate these Terms at any time by deleting your profile and ceasing your use of the Website entirely.

Solar Europe may terminate these Terms at any time if:

Solar Europe is required to do so by law (for example, where the provision of the Website to you is, or becomes, unlawful); or

The provision of the Website is, or becomes, in Solar Europe's opinion, no longer commercially viable.

Rights Infringements

Interpretation Guide

Headings: Headings are for convenience only and should not be used to interpret these Terms.

Liquidation or Sequestration: If a party mentioned in these Terms undergoes liquidation or sequestration (or a comparable process under a different legal system), these Terms will also apply to and bind that party’s liquidator or trustee, as applicable.

Gender, Person, and Number:

References to any gender include all genders.

References to a natural person include an artificial person and vice versa.

References to the singular include the plural and vice versa, unless otherwise indicated.

Days:

When specifying a number of days in these Terms, exclude the first day and include the last day, unless the last day falls on a Saturday, Sunday, or statutory public holiday in the governing jurisdiction. In such cases, the last day will be the next business day.

Generally, references to a “day” refer to typical business days.

Annexures, Addenda, and Amendments: All annexures, addenda, and amendments to these Terms form an integral part of these Terms and, therefore, our contract with you.
“Content”
All information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Website.

“the ECT Act”
The Electronic Communications and Transactions Act 25 of 2002.

“Electronic Communication”
Any text, voice, sound, image or video message sent over an electronic communications network which can be stored in the network or in the recipient’s terminal equipment until it is collected by the recipient or on the recipient’s behalf.

“Intellectual Property”
